Terms of Service
Last updated: October 25, 2026
These terms govern your use of AFPR — Andrew Finkle's Pattern Recognition ("AFPR"), including this website, the member platform, the Screener Suite tools, and the services that sit behind them (together, the "Service"). By creating an account, joining the email list, or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
What AFPR is — and is not
AFPR is an educational service. Everything published here — charts, commentary, screens, model portfolios, and teaching material — is general educational content published for a general audience. Nothing here is investment advice, a recommendation, an offer, or a solicitation to buy or sell any security, and nothing is personalized to your financial situation, objectives, or needs.
Andrew Finkle and AFPR are not registered investment advisers, brokers, or dealers, and are not financial advisors. AFPR does not manage money, hold client assets, or place trades. Consult a licensed financial advisor before making investment decisions.
Trading and investing involve substantial risk of loss, including the possible loss of principal. Past performance — anyone's, including anything shown here — does not guarantee or predict future results. Leveraged, options, and speculative strategies carry additional risk. You are solely responsible for your own trading and investment decisions.
Any performance figures, track-record references, roadmaps, or results mentioned in AFPR content are self-reported and unaudited, are shown for teaching context, and may not reflect the experience of any individual subscriber. Market data shown in the Service is end-of-day or otherwise delayed and may contain errors; do not rely on it as your sole basis for a trading decision.
Accounts and tiers
You need an account for the member area. Keep your credentials to yourself — accounts are personal and may not be shared or transferred. Access follows your tier (free, paid, lifetime, institutional) and the entitlement attached to your account. Institutional access is by application and personal approval only; there is no automatic institutional billing. We may refuse, suspend, or end an account that violates these terms.
The beta
Parts of the Service — including the Screener Suite — are offered as a beta. Beta features are provided as is, may be incomplete, may change or break without notice, and may be withdrawn. Beta access is a courtesy, not an entitlement: it may be revoked at any time, for anyone. In particular, as announced when the beta opened: when the platform launches, Screener Suite access becomes a benefit of the paid membership tiers. Accounts that have not upgraded to a paid tier at that point will lose Suite access. Beta feedback you send us may be used to improve the Service without compensation or attribution.
Billing
- Paid tiers are billed through Stripe; institutional members approved by AFPR may pay through the existing PayPal arrangement recorded on their account. Prices are shown before you pay and are in US dollars.
- Billing is currently paused. While the pause is on, no new charges are taken and no payment method is charged. We will announce before billing resumes, and resuming billing will never retroactively charge a paused period.
- Price-lock for migrating subscribers: subscribers who move from Annualize This on Substack to this platform keep the price promised to them at migration for the period promised. Your locked price is recorded on your account.
- Subscriptions renew at the end of each billing period unless cancelled; cancelling stops the next renewal and keeps your access until the period you paid for ends. Except where the law requires otherwise, payments are non-refundable — but if something has plainly gone wrong, write to andy@afpr.com and we will make it right.
- We may change prices for future periods; changes take effect no earlier than your next renewal after we announce them, and never override a price-lock recorded on your account.
Acceptable use
- No redistribution. Member content — charts, screens, data compilations, and commentary — is for your own use. Do not copy, republish, resell, screenshot for distribution, or otherwise share member content outside the Service, in whole or in part.
- Do not share your login, let others use your account, or create accounts for anyone else.
- Do not scrape, crawl, or bulk-download the Service, and do not interfere with its operation or security.
- In discussions, be civil: no spam, no impersonation, no unlawful, infringing, or harassing content. We moderate, and we may flag, hide, or remove comments and suspend accounts at our discretion.
- Do not use the Service for anything unlawful, or present AFPR content as investment advice to others.
Intellectual property and your content
The Service's content, design, indicators, and compilations are AFPR's intellectual property (or our licensors') and are protected by copyright and other laws; your subscription gives you a personal, non-transferable license to view it, nothing more. Comments you post remain yours, but you grant AFPR a license to display them within the Service and to moderate them under these terms.
Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFPR AND ANDREW FINKLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID AFPR IN THE TWELVE MONTHS BEFORE THE CLAIM. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
Third-party services
During the migration period, parts of the AFPR offering still run on third parties — the newsletter on Substack and institutional discussion on Slack — and payments run through Stripe and PayPal. Your use of those services is also governed by their terms; we are not responsible for their availability or conduct.
Changes, governing law, contact
We may update these terms; material changes will be announced in the member area or by email and take effect when stated, and continuing to use the Service after that means you accept them. These terms are governed by the laws of the State of Maine, USA, and any dispute will be brought in the state or federal courts located in Maine, unless applicable consumer-protection law gives you the right to bring it elsewhere. If any provision is held unenforceable, the rest remains in effect. Questions: andy@afpr.com.
